The Difference Between Assault and Battery

While assault and battery are often used interchangeably in standard conversation, there’s actually a difference between these two distinct crimes. While related, assault and battery are different and require a thorough understanding of what the charges mean when it comes to Colorado.

Generally speaking, an assault is when someone commits an act on another person that puts them in reasonable apprehension of contact that could cause harm. Battery is when a person commits an act that inflicts harm on the victim.

Assault and battery charges can be classified as misdemeanors or felonies and can result in time in a jail sentence , probation and hefty fines.

Here is how Colorado law defines assault and battery:

  • First-degree assault: When someone intentionally causes serious bodliy injury to another person with a deadly weapon
  • Second-degree assault: When someone knowingly  causes serious bodily injury to another person without a deadly weapon; or recklessly causes serious bodily injury using a deadly weapon.
  • Third-degree assault: When someone causes  injury to another person due intentional, knowing or reckless concuct.

Furthermore, Colorado assigns different penalties, when it comes to the different types of assault crimes. For exmaple, first-degree assault is a class 3 felony that can lead to up to 32 years in prison and fines up to $750,000. A second-degree assault is a class 4 felony, that can resul in up to 16 years in prison and fines up to $500,000. Whereas, a third-degree assault is a class 1 misdemeanor with up to 18 months in jail and fines up to $1,000.

Colorado revised statutes define assault as the unlawful causing of injury to another.

Battery is often referred to as the unlawful contact with another person.  This contact can fall into several different offenses depending on the intent behind the contact.
